A recently enacted U.S. Department of Labor regulation requires emphasis on Veteran Priority of Service as outlined in 20 CFR Part 1010 – Priority of Service for Covered Persons. A Covered Person is a veteran who has served on active duty and was discharged under conditions other than dishonorable and/or an eligible spouse:
1) Any veteran who died of a service-connected disability;
2) Any member of the Armed Forces serving on active duty who, at the time of application for the priority, is listed in one or more of the following categories and has been so listed for a total of more than 90 days: 1) missing in action; ii) captured in line of duty by a hostile force; or iii) forcibly detained or interned in line of duty by a foreign government or power;
3) Any veteran who has a total disability resulting from a service-connected disability, as evaluated by the Department of Affairs
4) any veteran who died while a disability, as indicated in paragraph (3), was in existence.
What is Veteran of Priority of Service? Priority of Service means, with respect to any qualified program, that a covered person shall be given priority over a non-covered person for the receipt of employment, training and placement services provided under the program. Priority means the right to take precedence over non-covered persons in obtaining services. Depending on the type of service or resource being provided, taking precedence may mean:
1) The covered person receives access to the service or resource earlier in time than the non-covered person; or 2) if the service or resource is limited, the covered person receives access to the service instead of or before the non-covered person.
Initially, this new requirement will result in emphasizing awareness in the One-Stop Systems Priority of Service for Covered Persons. This will be accomplished by providing information at the entry points for the Covered Persons to make them aware of their entitlement of priority of service; the full array of programs and services available to them; and, any applicable eligibility requirements for those programs and/or services. This also includes ensuring any DOL funded partner is made aware of what eligibility and priority of service means.
Veteran Priority of Service is federally mandated. All covered persons will receive priority of service over non-covered persons in all Department of Labor (DOL) funded employment and training programs. Here is a sampling of programs: Wagner-Peyser, Workforce Innovation and Opportunity Act – Adults and Dislocated Workers, National Emergency Act, Senior Community Service Employment, and Trade Adjustment Assistance.
Some of the services provided by these programs include labor exchange, resume writing, job search workshops, job search assistance, labor market information and career exploration. Priority of Service will be implemented for all programs such as universal access programs, programs with statutory priorities, and programs with discretionary priorities.
